Florida Medicaid Institutional Provider Agreement

3 (4) Term and Signatures. The parties agree that this is a voluntary AGREEMENT between the Agency and the SUPPLIER in which the SUPPLIER undertakes to provide services or goods to MEDICAID beneficiaries. Provided that all registration requirements are met, this AGREEMENT will remain in effect for three (3) years from the effective date of the SUPPLIER`s eligibility for initial registration, unless otherwise terminated. With respect to the re-registration of Suppliers, the CONTRACT shall remain in force for three (3) years from the date of expiry of the last CONTRACT or from the date on which THE SUPPLIER signs the Renewal Contract, whichever comes first, unless otherwise terminated. This AGREEMENT may be renewed only by mutual agreement. 7 (i) Proof of liability insurance at the option of the agency and maintenance of such insurance for any period during which goods services are provided to MEDICAID beneficiaries. (j) Accept the MEDICAID payment as a full payment and not charge or collect any additional amount from the recipient or the responsible party of the recipient, except and only to the extent that the Agency allows or requires co-payments, co-insurance or deductibles payable by the recipient for the services or goods provided. The MEDICAID payment policy does not apply to services or goods made available to a recipient if the services or goods are not covered by the MEDICAID program. This includes situations where the PROVIDER`s Medicare co-insurance claims are denied under medicaid policy. 5 (c) Retain all medical and MEDICAID-related records for a period of five (5) years to comply with all necessary requests from the Agency. (d) Protect the use and disclosure of information about current or former MEDICAID recipients and comply with all state and federal laws regarding the privacy of patient information. (e) send, at THE PROVIDER`s expense, any MEDICAID-related information that may take the form of records, logs, documents or computer files, and other information relating to services or goods billed to the MEDICAID Program, including access to all patient records and other PROVIDER INFORMATION, where the PROVIDER cannot easily separate MEDICAID patient records from other records; to the Attorney General, the federal government and the authorized representatives of each of these institutions. 8 (k) Meet all the requirements of section 6032 (Employee Education on the Recovery of False Claims) of the Deficit Reduction Act, 2005 if the SUPPLIER receives or earns five million dollars or more per year as part of the Crown plan.

(l) provide, within thirty-five (35) days of the date, at the request of the Secretary or medicaid agency, complete and complete information on the property of a subcontractor with whom the SUPPLIER has conducted business transactions totalling more than $25,000 during the twelve (12) month period ending on the day of the request; and all significant business transactions between SUPPLIER and a wholly-owned supplier or between SUPPLIER and a subcontractor during the five (5) year period ending on the date of the request. . 4 The SUPPLIER understands and accepts that no signature of the Agency is required to make this CONTRACT valid and enforceable. (5) Responsibilities of the PROVIDER. The MEDICAID SUPPLIER shall: (a) at the time of signing the SUPPLIER AGREEMENT, have a valid professional, professional, institutional or other license relevant to the services or goods provided and maintain in good standing for the entire period of validity of the CONTRACT as required by the State or place in which the SUPPLIER is located, and, if necessary, the federal government. (b) systematically and orderly maintain all medical and MEDICAID-related records required by the Agency and determine that they are relevant to the services or goods provided. 9 (m) Employ only persons legally authorized to work in the United States, whether citizens or foreign nationals, who have the right to work in accordance with the Immigration Reform and Control Act of 1986, which prohibits employers from knowingly hiring illegal workers. (n) Use the Department of Homeland Security`s E-Verify employment eligibility verification system to verify the employability of all persons employed by SUPPLIER during the term of this Agreement to perform employment duties in Florida, as well as all persons (including subcontractors) engaged by SUPPLIER to perform work under this Agreement. The SERVICE PROVIDER will include this provision in all subcontracts it concludes for the execution of work under this contract. 2 (2) Quality of Service.

The PROVIDER agrees that the services or goods invoiced to the MEDICAID program are medically necessary, of a quality comparable to those provided by the PROVIDER`s colleagues and within the parameters authorized by the LICENSE OR THE CERTIFICATION OF THE PROVIDER. The SERVICE PROVIDER also undertakes to invoice only the services provided within the framework of the specialty or specialties indicated in the SERVICE PROVIDER`S REQUEST filed with the Agency. .
